Please read these Terms and Conditions carefully before using our website or placing an order. By using our website or placing an order, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website.

1. About Us

Cheshire Pie Company Ltd is a company registered in England and Wales. Our registered office and trading address is 8 Bold Street, Sandbach, CW11 1GR. You can contact us by email at info@cheshire-pie.co.uk or by telephone on 01270 768999.

2. These Terms

2.1 These Terms and Conditions, together with our Privacy Policy and Cookie Policy (published on our website), form the entire agreement between you and Cheshire Pie Company Ltd in respect of your use of our website and any orders you place with us.

2.2 We may update these Terms and Conditions at any time. The version in force at the time you place an order is the version that will apply to that order. We recommend you check this page before each purchase.

2.3 These Terms and Conditions are governed by English law and apply to customers based in the United Kingdom.

3. Placing an Order

3.1 All orders placed through our website are subject to acceptance by us. We reserve the right to refuse any order at our sole discretion.

3.2 When you place an order, you confirm that:

  • you are at least 18 years of age;
  • all information you have provided is accurate and complete, including your name, delivery address, email address and telephone number; and
  • you are authorised to use the payment method provided.

3.3 Once you have placed your order, you will receive an email acknowledgement. This acknowledgement does not constitute acceptance of your order. A binding contract between you and us is formed only when we send you a dispatch confirmation email.

3.4 We are unable to add items to an existing order once it has been placed. Our pie packs have limited capacity and orders are prepared promptly after submission. If you require additional items, please place a new order.

3.5 We will endeavour to assist with changes to delivery addresses or contact details prior to dispatch. Please contact us as soon as possible at info@cheshire-pie.co.uk or 01270 768999.

4. Pricing and Payment

4.1 All prices on our website are quoted in pounds sterling (£) and include VAT where applicable. Prices are correct at the time of display but may change at any time without notice.

4.2 The price applicable to your order is the price shown at the time you complete checkout.

4.3 Our website is hosted on Shopify Inc. Payment transactions are processed securely through Shopify Payments and/or other Shopify-approved payment providers. We do not store or have direct access to your full card details. Payment is taken at the time of order.

4.4 Shopify's handling of payment data is governed by Shopify's own privacy policy and PCI-DSS compliance standards. For more information, please visit www.shopify.com/legal/privacy.

4.5 If a pricing error is discovered after your order has been placed, we will contact you promptly. You will have the option to confirm your order at the correct price or cancel it for a full refund.

5. Cancellation Rights

5.1 Under the Consumer Contracts Regulations 2013, consumers ordinarily have the right to cancel an online order within 14 days of receipt without giving a reason.

5.2 However, because our products are perishable goods (fresh food), this right to cancel does not apply once your order has been dispatched. This exemption is expressly permitted under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013, which excludes goods that are liable to deteriorate or expire rapidly.

5.3 If you wish to cancel your order before it has been dispatched, please contact us immediately at info@cheshire-pie.co.uk or 01270 768999. We will do our best to stop the order, but we cannot guarantee cancellation once picking and packing has commenced.

5.4 Nothing in this clause affects your rights in respect of goods that are faulty, misdescribed or not of satisfactory quality — please refer to clause 8 (Refunds and Remedies).

6. Delivery

6.1 Due to the fresh nature of our products, all orders are sent on a 24-hour tracked courier service. By placing an order you agree to this delivery method.

6.2 Estimated delivery timescales are provided by the courier once your parcel is dispatched. These are estimates only and are not guaranteed.

6.3 Delivery is to the address you specify at checkout. Please ensure this is accurate. Neither we nor our courier will be liable for non-delivery or deterioration of goods resulting from an incorrect address provided by you.

6.4 Because our products are perishable, it is important that someone is available to receive your delivery, or that you provide a safe place for the parcel to be left. You should:

  • be present at the delivery address on the expected delivery date; or
  • provide clear instructions for a safe place where the parcel can be left.

6.5 If you do not provide a safe place and no one is available to accept delivery, the courier may, at their discretion, leave the parcel with a neighbour, in a sheltered area of your property, or return it to the depot. We accept no liability for spoilage arising from any of these outcomes.

6.6 Once your parcel has been dispatched, please do not attempt to change or redirect your delivery date or address. Doing so may result in spoilage of the product, for which we will not be liable and for which no refund or replacement will be provided.

6.7 Please note that our courier operates a 48-hour delivery window for next-day parcels in exceptional circumstances. Our packaging is designed and regularly tested to keep your products at a safe, cool temperature for up to 48 hours to provide reassurance in such cases.

7. Product Information

7.1 We take care to describe our products accurately. However, product images on our website are for illustrative purposes only and the appearance of delivered products may vary slightly.

7.2 Product content and ingredients may change from time to time. Please refer to the label on delivery for the most up-to-date allergen and ingredient information. If you have specific dietary requirements or allergen concerns, please contact us before ordering.

7.3 Our products contain meat and other allergens. It is your responsibility to check the product label upon receipt before consumption.

8. Refunds and Remedies

8.1 Your statutory rights under the Consumer Rights Act 2015 are not affected by anything in these Terms and Conditions. In particular, goods supplied by us must be of satisfactory quality, fit for purpose and as described.

8.2 If your goods arrive damaged, spoiled (for reasons within our control), or not as described, please notify us within 48 hours of receipt by contacting info@cheshire-pie.co.uk or calling 01270 768999. Please include:

  • your order number;
  • a description of the problem; and
  • clear photographic evidence of any damage or spoilage.

8.3 Where we are satisfied that a valid issue has arisen due to our fault, we will, at our discretion:

  • provide a full or partial refund to your original payment method; or
  • send replacement goods at no additional charge.

8.4 We will process refunds within 14 days of agreeing that a refund is due. Refunds will be made to your original payment method.

8.5 We will not accept responsibility for, and will not offer refunds or replacements in respect of:

  • spoilage or deterioration arising from your failure to be available to accept delivery or to provide a safe place for delivery;
  • spoilage arising from your request to change the delivery date after dispatch; or
  • complaints notified more than 48 hours after receipt of goods.

8.6 Nothing in this clause limits your rights under the Consumer Rights Act 2015 where goods are faulty or misdescribed.

9. Liability

9.1 We shall not be liable for any indirect, special or consequential loss or damage arising out of or in connection with your use of our website or any order placed with us, including but not limited to loss of profit, loss of data, or loss of goodwill.

9.2 Our total liability to you in respect of any order shall not exceed the total price paid by you for that order.

9.3 Nothing in these Terms and Conditions shall exclude or limit our liability for:

  • death or personal injury caused by our negligence
  • fraud or fraudulent misrepresentation;
  • any breach of your statutory rights as a consumer under the Consumer Rights Act 2015; or
  • any other liability that cannot be excluded or limited under the law of England and Wales.

10. Dispute Resolution

10.1 If you have a complaint, please contact us in the first instance at info@cheshire-pie.co.uk or 01270 768999. We will acknowledge your complaint promptly and aim to resolve it within 14 days.

10.2 If we are unable to resolve your complaint to your satisfaction, you may wish to use an Alternative Dispute Resolution (ADR) scheme. Details of certified ADR providers are available from the Chartered Trading Standards Institute at www.tradingstandards.uk.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Assignment

12.1 You may not delegate, transfer or assign these Terms or any of your rights or obligations under them without our prior written consent, and any such attempt will be null and void.

12.2 We may transfer, assign or delegate these Terms and our rights and obligations under them without your consent or prior notice to you.

13. Indemnification

13.1 You agree to indemnify, defend and hold harmless Cheshire Pie Company Ltd, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal costs, payable to any third party arising out of:

  • your breach of these Terms or any document incorporated by reference;
  • your violation of any law or the rights of a third party; or
  • your access to and use of the Services.

13.2 We will notify you of any indemnifiable claim promptly (provided that a failure to notify promptly will not relieve you of your obligations unless you are materially prejudiced as a result). We may control the defence and settlement of such a claim at your expense, but will not settle any claim requiring non-monetary obligations from you without your consent (such consent not to be unreasonably withheld).

14. Severability and Waiver

14.1 If any provision of these Terms is found to be unlawful, void or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law and the unenforceable portion shall be deemed severed from these Terms. Such a finding shall not affect the validity and enforceability of any other remaining provisions.

14.2 Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or rules posted on our website, constitute the entire agreement between you and Cheshire Pie Company Ltd and govern your use of the Services, superseding any prior or contemporaneous agreements, communications or proposals, whether oral or written.

12.1 You may use our website for your own personal, non-commercial purposes. You may print or download content from our website for personal use only.

18. Website Hosting and Availability

18.1 Our website is hosted by Shopify Inc., a third-party e-commerce platform. By using our website you acknowledge that Shopify provides the underlying technology and infrastructure for our store.

18.2 We take all reasonable steps to ensure our website is available at all times. However, we do not guarantee uninterrupted access and will not be liable for any unavailability caused by Shopify platform issues, technical faults, maintenance, or circumstances beyond our reasonable control.

18.3 We may temporarily suspend our website for maintenance or updates. Where possible we will give advance notice of any planned maintenance.

18.4 Shopify's platform terms are available at www.shopify.com/legal/terms. Our use of Shopify does not affect your statutory rights against Cheshire Pie Company Ltd as the seller.

19. Third-Party Links

19.1 Our website may contain links to third-party websites for your convenience. These links do not imply our endorsement of those websites. We have no control over their content and accept no responsibility for them.

19.2 If you access a third-party website linked from our site, you do so at your own risk.

20. Accuracy of Information

20.1 We endeavour to keep the information on our website accurate and up to date, but we make no warranties as to its completeness or correctness. We may change content at any time without notice.

20.2 Pricing, product descriptions and availability are subject to change. Please verify details at checkout before placing your order.

21. Prohibited Uses

21.1 You may access and use the Services for lawful purposes only. You must not access or use the Services:

22. Agents and Automated Access

22.1 This clause applies if you use, allow, enable or cause the deployment of an automated agent (including any AI-powered tool or autonomous software) to access, use or interact with the Services (an "Agent").

22.2 No Agent may access or interact with the Services unless it, at all times:

  • does not conceal or obfuscate that interactions are from an Agent (for example, by mimicking human behaviour or circumventing CAPTCHAs);
  • responds truthfully to any prompt seeking to determine whether interactions are from a human or a computer; and
  • does not circumvent any measure we use to block, limit or control automated access to the Services.

22.3 We may limit or block Agent access to the Services by technical or other means at any time without notice. Any Agent access not compliant with this clause is unauthorised and may constitute a breach of these Terms.

23. Feedback and Reviews

23.1  If you submit any ideas, suggestions, feedback, reviews or other content to us (collectively "Feedback"), you grant Cheshire Pie Company Ltd a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including to operate, improve and promote the Services.

23.2 You represent and warrant that:

  • You own or have all necessary rights to any Feedback you submit;
  • You have disclosed any compensation or incentive received in connection with your Feedback; and
  • Your feedback complies with these Terms and does not violate any third-party rights.

23.3 We are under no obligation to maintain your Feedback in confidence, to pay you for it, or to respond to it. We may, but are not obliged to, monitor, edit or remove Feedback that we determine to be unlawful, offensive, defamatory, or otherwise objectionable.

24. Our Relationship with Shopify

Cheshire Pie Company Ltd is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make through our store are made directly with Cheshire Pie Company Ltd. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Cheshire Pie Company Ltd, including any injury, damage or loss resulting from products purchased. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Cheshire Pie Company Ltd.
